Terms & Conditions
Create//Succeed is a trading name of John Turner Leisure Marketing Ltd (“JTLM”).
Any Agreement governs:
(a) the Create//Succeed email broadcasting service,
(b) the set-up of a branded domain name(s), and mailbox(es) for the purpose of facilitating said broadcasting.
(c) the hosting of the prospect data, the Client’s target audience
- Once the order form is signed you will be invoiced a one off account set up fee of £300 +VAT, and provided with a Client Briefing Form. This is required to be returned within 3 working days to avoid delay to the email activity. A Briefing Deep Dive session will also be scheduled.
- Your subscription will begin on Week 5. In the first 4 weeks following receipt of the account setup fee we will work on:
Emails: account set up, copywriting, campaign sequencing, data sourcing and inbox warming to maximise email delivery and engagement.
LinkedIn: account set up on Dripify, and LinkedIn Ads, data sourcing, campaign sequencing, copywriting and design to begin the audience warming ahead of emails
Payment will then be taken automatically every 7 days.
- The weekly subscription fee of £250 +VAT includes the email sequence optimisations, account monitoring, broadcasting, mailbox reputation management, LinkedIn campaign optimisations, LinkedIn Advert performance optimisations, prospect data sourcing, and reporting.
The initial term is a minimum of 4 weeks campaign activity following the account set up period. For the avoidance of doubt this would be Week 5 to Week 8 of the agreement.
- We require 7 days notice to pause or cancel activity. We can pause your account for a weekly charge of £30+VAT, or £100+VAT per Quarter. This allows us to maintain the mailboxes, and other software management. We can then restart your activity and avoid any duplication of account set up charges, or prospect messaging. If you cancel and wish to restart activity in the future, we would form a new agreement including account set up fees.
- We research and create the prospect data lists on a 4 weekly cycle, allowing for up to 3 sequential messages to be sent to each contact in that period. Any requested changes to this targeting can be factored into the next monthly activity cycle.
- A clear reason for the legitimate interest in contacting each prospect will be included in each email send, in addition to a clear Unsubscribe mechanic. A Legitimate Interest Assessment will also be completed, and will require Client signature before broadcasting commences.
- We cannot guarantee a specific number of leads, or that each prospect will receive or view each email, or LinkedIn activity. A variety of factors will contribute to the campaign success - including but not limited to 3rd party incoming mail settings, the strength of the product or service on offer, pricing and promotions, the target market and quality of prospect data available. Numbers quoted across our website and social channels are based on averages from our experience and previous client campaigns.
- A “lead” is defined as someone who could become a customer of yours. They may respond to the email we send on your behalf, or reply with a more suitable colleague to contact. They could contact your business following receipt of LinkedIn activity, or the emails, after taking another action first - such as visiting your website or social media channels.
- You grant us permission to purchase a domain name(s) similar to your existing website and brand marks, as well as permission to use this domain name for mailboxes sending emails on your behalf. We own this new domain and it will remain active for as long as your subscription remains valid. Upon any agreement termination the domain name renewal will be cancelled and be available on the open market after the purchase term expires.
- You will grant us access to the 3rd party platforms necessary to fulfil our service obligations - such as Dripify and LinkedIn Ads.
- Usage of Third-Party Tools: While we recommend certain third-party tools and services, to enhance your LinkedIn prospecting and marketing efforts, we do not endorse or guarantee their performance or reliability. The use of any third-party tools or services is entirely at your own risk.
- Account Suspension or Blocking: We cannot be held responsible for any consequences arising from the use of third-party tools or services, including but not limited to the suspension, restriction, or blocking of your LinkedIn account or any other platform accounts. It is your responsibility to ensure that your use of such tools complies with the terms and conditions of the respective platforms.
- Limitation of Liability: Our company will not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of third-party tools or services. This includes, without limitation, any loss of business, revenue, profits, data, or other economic advantage.
- Compliance and Best Practices: We advise all clients to adhere to the best practices and guidelines set forth by LinkedIn and other platforms to avoid any potential issues. It is recommended to stay informed about the terms of service and policies of the platforms you are using. In addition we will use best efforts and known best practice to ensure any campaigns we run on your behalf remain compliant.
- If any Deliverables use any trademarks, trading styles or trade names (‘Marks’) owned by the Client or under its control, it is agreed that the Agency shall have the right to use or allow use of any such Marks for the purpose of fulfilling the Agency’s obligations under the Agreement. The Agency shall not gain any rights over such Marks by virtue of such use, but the Agency shall be entitled to use the Marks both during and after the production and supply of the Deliverables to promote and advertise its own work. It shall be the Client’s responsibility to ensure that all domain names used in connection with the Deliverables do not infringe any third party rights and that any Marks of the Client or any third party used in the Deliverables, including such Marks as are supplied by the Agency as part of the Brief, are used in a manner which neither undermines the Client’s rights in its Marks nor infringes any third party rights.
